Welcome to HouseKraft, an online image editor application. These Terms of Service ("Terms") govern your use of the HouseKraft website and services (collectively, the "Service"). The Service is owned and operated by 172 Tech and developed by ESS ENN Associates.

• Ownership: You retain all rights to the images and other content you upload, create, or edit using the Service ("User Content"). We do not claim any ownership rights over your User Content.
• License: By uploading User Content, you grant us a non-exclusive, worldwide, royalty-free, transferable, and sublicensable license to use, reproduce, modify, adapt, publish, and display your User Content for the sole purpose of operating, providing, and improving the Service. This license terminates when you delete your User Content from the Service.
• Responsibility: You are solely responsible for your User Content. You represent and warrant that you have all necessary rights to your User Content and that your User Content does not violate any third-party rights, including copyright, trademark, privacy, or publicity rights. You agree not to upload any User Content that is illegal, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable.

Prohibited Conduct

You agree not to use the Service to:

• Upload, post, or transmit any User Content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.

• Upload, post, or transmit any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation.
• Upload, post, or transmit any material that contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment.
• Violate any applicable local, state, national, or international law.
• Interfere with or disrupt the Service or servers or networks connected to the Service.
• "Stalk" or otherwise harass another.

Intellectual Property

The Service and all content and materials available on the Service, including but not limited to text, graphics, logos, button icons, images, and software, are the property of 172 Tech or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not use any of the trademarks, logos, or other proprietary information without our express written consent.

Termination

We may terminate or suspend your access to the Service at any time, with or without cause, with or without notice, effective immediately. If you wish to terminate your account, you may simply discontinue using the Service. All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE MAKE NO WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE.

Limitation of Liability

IN NO EVENT SHALL 172 TECH, ESS ENN ASSOCIATES, OR THEIR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES (EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (A) THE USE OR THE INABILITY TO USE THE SERVICE; (B) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE SERVICE; (C) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (D) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE; OR (E) ANY OTHER MATTER RELATING TO THE SERVICE.

Indemnification

You agree to indemnify and hold harmless 172 Tech, ESS ENN Associates, and their affiliates, officers, agents, and employees from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that such parties may incur as a result of or arising from your (a) violation of these Terms; (b) use of the Service; or (c) violation of any rights of any other person or entity.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Chandigarh, India.

Changes to Terms

We reserve the right to modify these Terms at any time. We will post the revised Terms on the Service and update the "Last Updated" date at the top of this page. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
